London Tribunals - April 21

In April 2021 adjudicators at London Tribunals decided on the fate of 43 PCNs. They cancelled 14, a mere 32%, which is below the usual rate and perhaps reflective of the fact that moving traffic PCNs are much harder to beat than ones for parking.

Four decisions stood out:

Adjudicator asks council to be kind, cancellation beyond his powers (2210138912)

Blue badge stolen (2210107511)

Breakdown evidence of doubtful provenance (2210105312)

Crash or PCN? (2210128646)

London Tribunals - March 2021

Due to Covid the number of PCNs being decided at the independent adjudicators remains depressed. In addition, probably thanks to there being more moving traffic cameras around the borough of Barnet the success rate of motorists has diminished as the cctv evidence is usually conclusive.

In March there were 72 PCNs in front of adjudicators and only 23, a mere 32%, were cancelled.

Two cases were a little out of the ordinary and both concerned the health of individuals about which it appears that Barnet Council doesn't care about at all, with revenue raising being more important.

In labour in a yellow box (2210051508)

The law does not allow the adjudicator to cancel on grounds of mitigation and so his hands were tied.

Covid - the council don't care (221006361A)

Other cases of note

Inadequate signage (2210090940)

The image at the top of the blog post illustrates how you would easily miss the single sign.

Footway parking (2210055043)

The trouble with a traffic warden giving you verbal permission is twofold; 1. it isn't written down and 2. a different traffic warden gives you the PCN.

Best to stay off the footway unless there are marked bays or signs which permit it.

London Tribunals - February 2021

There were 66 cases decided in February 2021.

Of those 24 went the way of the motorist, a mere 36% which is lower than average.

Only 2 cases were out of the usual run of things.

NSL contract not signed (2200503669)

I wonder what is taking so long? Two years and the ink isn't yet even on the contract, never mind dry.

Avoiding an accident or a £130 penalty (2210016722)

Common sense thrown out of the window, it appears that Barnet Council expect you to have a  head on collision rather than dip a wheel into a bus lane. Do the people who reject these perfectly valid representations even drive?

London Tribunals - January 2021

In January 2021 there were 82 PCNs decided upon at the tribunal.

Of those, only 31, that is 38%, went the way of the motorist.

Quite a few of those cases were in yellow box junctions and they can be hard to beat.

The following cases were of note:

System not clear (2200496213)

Service must be at the last known address. (2200496665)

A rare sighting of the word 'dispendious'.

School keep clear markings in an emergency (2200538244)

London Tribunals - December 2020

Clones

Another quiet month for Barnet PCNs at the tribunal with 63 cases being decided of which the motorist won 34 which is 54% a slightly better than average result but that is normal for December as PCNs get abandoned in order for the council to have a clear desk.

Cases of interest included these:

3 point turn on a school keep clear marking after a funeral (2200471201)

Take your heart out before going to work in a council office dealing with PCNs

Cloned - not been to London for a decade (2200469491)

Barnet Council are habitually reluctant to accept cloning occurred but given the distance there is obvious logic and the police visit renders the question almost beyond doubt.

Suspended bay not clear (2200492063)

If the sign can't be seen the traffic warden knows this when he/she stands next to the car to issue a PCN. Completely unfair behaviour.

Council shift their position unfairly (2200494626)

Barnet Council are as slippery as sin in this case but justice prevails.
